Amazing how fast tech gets away from the law's ability to regulate it. ECPA addressed pen registers and hardware tracking devices, need a warrant for those, but that was when cell phones were only for cars.

I can see how conservatives would be against this ruling since they tend to be strict constructionists of the Constitution and cell phones weren't mentioned in the Constitution. Liberals tend to think the Constitution can grow from original intent to encompass the changes in society and technology the Founding Fathers could never have imagined. The Fourth Amendment states: "The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized."

Today's cell phones are the equivalent of "papers" and "effects" specified in the Constitution and therefor are protected from unreasonable search and seizures.

To hold that position you would have to be an ignoramus and could not possibly be an educated person of the law.

It is an excuse used by bigots, racists and thieves.

That they are not ignoramuses or uneducated makes them all the worst racists, bigots and thieves.

Gorsuch must be removed, peacefully and Garland put in his place, until that happens we do not have a SC
