Establishes that Presidential records automatically transfer into the legal custody of the Archivist as soon as the President leaves office.

Facts First: Nothing in the Presidential Records Act suggests that there should be a negotiation between a former president and the National Archives and Records Administration over what presidential records should be turned over to NARA and when – much less that there should have been a months-long battle after NARA first sought the return of records from Trump in 2021. The law simply says that, when a president leaves office, NARA assumes control of all presidential records.

And anything the president deems personal is excluded from the archivist. DC court of appeals has weighed in and stated it’s the President’s discretion to determine what’s his. Court also said that agencies could challenge bin court and get stuff back. Like classified material. Still no crime.

Same applies to the VP.

Presidential Records Act has no enforcement mechanism. And if ever challenged before the Supreme Court it would be toast. Another reason why the DOJ might steer clear of further action.

Not true. That case was an outlier, and not relevant to this. Trump had nuke secrets. Trump can’t say that’s his.

And Trump is guilty of Obstruction of Justice. But hey you’ll always be on his side won’t you?

When a federal district court judge declares a presidential power it applies to all situations. As long as he took possession while President he’s protected.

No, the case was not central to the law. It was an outlier.

I think this goes to the point that we have a problem with the process of tracking and accounting for classified materials. If we send everyone to jail for this we will most definitely “drain the swamp”. They will all be in jail.

But let’s just remember. On his first day on the job, he had Russian KGB goons into the Oval Office - the first time that’s EVER been allowed - and immediately gave them classified information.

He also trust what Putin says over what our own intel agencies says.

So he’s certainly capable.

I have this feeling that a search of Obama, Shrub's, or Cheney's home would turn up classified docs. I don't know that any of them took any of them deliberately for nefarious purposes. We don't even know this for certain in Trump's case; but one can argue other behaviors at least certainly raise those suspicions. In general, I agree that we need a better system of tracking these things and their whereabouts.

The only thing I will note is at least Pence cooperated once the situation was known, as did Biden. That's the difference that matters. And THAT is why their homes did not need to be raided.

Agreed that it's all the same until you remember that drumpf wouldn't give up his stash and the FBI had to forcibly execute a warrant and take it. Also, for those who care, drumpf's stash was more than just a few papers, more like a commercial quantity.
