As a financial person, when fraud in the inducement is alleged, we have to prove both a material misstatement and reliance on that misstatement. In this case, there may well have been misstatements but no lender relied on those statements to make lending decisions. Real estate lenders do their own due diligence to arrive at real estate valuations. They never rely on the borrowers statements of value. I’ve been doing this over 35 years and I have never seen a loan on real estate that didn’t involve the lender doing their own due diligence. In this case there are no victims. None. No lender is a victim. If you want to fine the man for making false statements then those fines can’t be based on actual damages unless you can produce actual victims. This looks a lot like a money grab by the state and politically motivated. Show me a case where NY hauled in a borrower on a charge like this when there was zero loss to the lender and the loan never went into default. Also show me where such fines were imposed for false statements when there were no victims and no damages. I haven’t heard of such a case. Maybe you have. You claim it isn’t unprecedented or unreasonable so there must be case history or you wouldn’t make such claims.

During an interview with former federal prosecutor Alex Little, Shawn noted that Trump had repeatedly made the claim about the $545 million bond.
"We've also heard there's a lot of talk about this is unprecedented amount of money," Shawn explained on Sunday. "This has never happened before. But that's actually not true."
"This is from Letitia James, the attorney general's own court papers on the show to right now," he continued. "There have been bigger bonds in the history book from one billion dollars to one and a half billion dollars. That was a Carnegie Mellon patent case."

Specifically, he complained, "Maria, they were laughing. They were laughing. Top executives of the largest surety companies had never seen anything of this size. And what, they're going to start seizing assets if he can't put up something that's not available in the United States?"
That opened the door for critics of the Trump family to pile on, with one commenter writing, "They wouldn’t have laughed at real Billionaires."
After that, came the deluge of snarky comments.

This is the 5th time in this case that he has been overturned, a record. His credibility, and that of Letitia James, has been shattered. We will abide by the decision of the Appellate Division, and post either a bond, equivalent securities, or cash. This also shows how ridiculous and outrageous Engoron’s original decision was at $450 Million. I DID NOTHING WRONG, AND NEW YORK SHOULD NEVER BE PUT IN A POSITION LIKE THIS AGAIN.
