Menendez should be expelled from the senate.
Fetterman, iirc, called for that or for him to resign. Iirc, several other Democratic politicians did the same.
I do not know the process that the senate would use as it may be different than the house.

I'm not fully informed about the Menendez case, but from what I've read he's a good candidate for a thorough review followed by disciplinary action if warranted. I don't have a double standard here. Fuck up and out you go.

Santos' and Menendez's cases are different.
Santos is facing federal charges and the House Ethics committee found substantial evidence he violated federal law.
Menendez is facing numerous federal charges but the Senate, to my knowledge, hasn't investigated him.
Both Santos and Menendez retain the right of innocence until proven guilty in a court of law and being indicted, but not yet convicted, doesn't justify removal without due process. However, being a member of Congress, their respective houses have the authority and power to investigate charges against them and recommend removal. It's up to the members of their respective houses to determine if they should be removed.
IMO, Menendez should resign because he's been facing accusations like this for years and now charges have been filed against him. If he won't resign, the Senate needs to investigate him and if they find evidence to support the charges then they need to vote him out of the Senate.

A number of democrats have called for Menendez to resign or be expelled. The republicans want him to stay in the Senate and win his primary in New Jersey. Then you will see what their intent is. They do not want him out until he can be weaponized in the election.
