SACRAMENTO, Calif. (AP) — The 9th U.S. Circuit Court of Appeals overturned a ruling by two of its judges and upheld California’s ban on high-capacity magazines Tuesday in a split decision that may be headed for the U.S. Supreme Court.

“The statute outlaws no weapon, but only limits the size of the magazine that may be used with firearms,” the court said in the 7-4 ruling.

https://apnews.com/article/us-supreme-c ... 793a92d776
When I was growing up in Colorado there wasn't a ban on high-capacity magazines, however if a magazine held more than 4 shells and a person was hunting with the rifle that held that magazine, that was a serious violation and a person would get a ticket and have to go to court and see a judge.

I had a rifle with a fixed magazine which held 6 shells. To fix it so I could use the rifle for hunting I had to make and install a piece of wood inside the magazine such that it blocked enough space in the magazine that it wouldn't allow for more than 4 shells to be stuffed into it. It worked but it caused the top shell to be pressed in way too tight because the wood bunched the spring, and that caused the action to not work,

But it would work OK with only three shells in there and that was OK with the law, and OK with me because I never missed and didn't need more than the one shell in the chamber.

The United Nations headquarters in New York City was locked down on Thursday after police said they were responding to several reports of a man allegedly holding a gun outside the office, AFP reported.

GOP blocks bill to expand gun background checks after Michigan school shooting

Sen. Chuck Grassley (Iowa), the ranking Republican on the Senate Judiciary Committee, on Thursday blocked a request to proceed to legislation passed by the House in March to expand background checks for gun sales, a priority that has languished in Congress for years.

Sen. Chris Murphy (D-Conn.), a leading advocate for gun control legislation, asked for unanimous consent to proceed to the House bill, citing the recent school shooting in Michigan that left four students dead.

A crime spree that started with deadly shootings in Denver Monday didn’t end until five people were killed, including the suspect. On Tuesday, a mourning father visited a growing memorial outside Sol Tribe Tattoo, telling CBS4 that one of the victims was his daughter, Alicia Cardenas.

Surprised this even makes the news. Anywhere else in the world of course this is a GIGANTIC story, but here where cons daily say and do nothing about the harm they do, no big deal.

The downright fucking stupidity of thinking you need a gun to protect yourself from others who have them as a reason not to enforce the 2nd amendment and remove them all to a well-regulated militia shows just how dumb they are.

Choice one: everyone has a gun, people are dying by the thousands each day from guns as a result

Choice two: nobody has a gun, nobody dies from gun violence ever.
I sigh in your general direction.

Oh Dear, I followed the links and what I found was an opinion survey that was dressed like it was a scientific paper published in what I regard as being a fake journal.

I opened the so called scientific paper up and found that it was not even a decent survey, instead it was one of those "opt in" cheesy Internet methods that generates a very high N so they can claim a low error rate, but lacks any real controls to insure randomness of sample which is the bench mark standard for any reputable opinion survey.

Ignoring that there was no controls to insure a random sample the results are an opinion survey where they asked gun owners if they had used a gun to protect themselves. Oh course many would say that irrespective of whether it was true. The world abounds with windy folks who will say the damnedest things if even slightly are encouraged to do so.

I rate this so called "study" as being nothing at all.

Even if it were accurate ... it doesn't really have anything to do with the question of what we might need to do re gun control reform or prevent mass shootings.

Colorado shooting spree suspect IDed, police believe victims were targeted
Investigators have identified the man who killed six people during a shooting spree in two Colorado cities Monday night.

Lyndon McLeod, 47, was killed by police after police say he carried out shootings in at least six locations across Denver and Lakewood........

.......Three of the victims were at tattoo shops when they were killed. Alicia Cardenas and Alyssa Gunn-Maldonado were at Sol Tribe Tattoo and Piercing on Broadway in Denver. Danny Scofield was at Lucky 13 Tattoo on Kipling Street in Lakewood.

Additionally, a woman working at a Hyatt House was killed by McLeod inside the hotel. Police said Tuesday afternoon a sixth person had died, but didn’t immediately identify them.

Another shooting scene in Denver is where the Secretary of State’s office says McLeod once owned a tattoo shop called Flat Black Ink.

Police said they believe McLeod was targetting all of the people he shot, although they did not release a motive.

Nexstar’s KDVR spoke to Gabriel Thorn, a man who bought his home from McLeod about five years ago.

“There were numerous hidden gun safes in the walls of this house,” Thorn said. “He just disappeared off the face of the earth when we bought the house. My wife and I joke that he’s changed his name and moved out of the country.”

McLeod hadn’t legally changed his name, but he did write and publish a series of books called “Sanction” under the name Roman McClay. McLeod named the main character in the book after himself, and in a YouTube interview said the premise is that the narrator is artificial intelligence.......
he has a few interviews about his book

Look at this conservative freak.

‘The Weak Better Buckle Up’: Denver Gunman Left Online Trail of Hate - Daily Beast
McLeod, who was killed by a Lakewood police officer Monday after shooting her in the abdomen, captioned the photo with a quote from one of his characters in his series: “It’s not really a worm so much, however I understand the point.”

He also gleefully indicated that some people required violence to be addressed. While discussing a 2014 YouTube video titled, “Mike Tyson DESTROYS Reporter!” on Twitter, McLeod, as McClay, blasted the “passive aggressive” reporter and praised Tyson for using “Direct Aggression”—all before hinting at threats of violence for the “WEAK.”

“This is basically the plot to my stupid book,” he wrote in April 2020. “Our entire society is made up of shitty little fucks who insult badasses & get away with it because law enforcement & social norms protect the WEAK from the STRONG. I’m over it.”

“The weak better buckle up... shit is about to get real,” he wrote.

Right-wing rapper and social media personality Nzube Olisaebuka Udezue—known as Zuby—hosted McClay on his podcast to discuss Sanction in 2019. The host claimed the book was “currently blowing up Twitter,” though he admitted he had not read it.
Zuby - Wikipedia
In March 2019, Udezue received worldwide attention after posting on Twitter a video of himself performing a deadlift of 238 kg (525 lb) and subsequently stating he had broken the British women's deadlift record while "identifying as a woman".[3][4][31][5] Shortly after, he made similar comments about the British women's bench press record.[4][3] The tweets added to the ongoing debate about transgender people in sports.[4][5] Udezue has said he does not think trans women should be allowed to compete in women's sport.[5] Udezue went on to say he posted the tweets to demonstrate the "fallacies of the arguments on the other side" and commented: "I have seen people saying there is no inherent biological strength difference between men and women. I posted it being a bit tongue-in-cheek, showing what I think is the obvious absurdity of their argument."[4] After he expressed these views, Rosamund Urwin of The Times described Udezue as an "unlikely feminist icon".[4]
Zuby sounds like Glennfs. :problem:

‘The Weak Better Buckle Up’: Denver Gunman Left Online Trail of Hate - Daily Beast
Insane Social Darwinist freak finally snaps, decides to take out what he sees as "the weak" on his own killing spree.

Surprise, film at 11.

Seems to be this story in a nutshell.

Alleged Denver, Lakewood killer wrote novels that contained scenes similar to Monday's rampage
Lyndon McLeod self-published a series of books filled with hatred and violence.
https://www.9news.com/article/news/inve ... 0cc7c078e6

DENVER — Lyndon McLeod, the man who police say shot and killed five people on Monday in Denver and Lakewood, self-published a trilogy of dystopian, misogynistic, violence-laden fantasy books two years ago, sources confirm to 9Wants to Know.

The first two books were published in 2019, and the third in 2020. The plot of the second book bears a striking and frightening resemblance to Monday’s deadly real-life attack.

Writing under the pen name Roman McClay, McLeod titled the trilogy “Sanction.” In “Sanction Book 2,” the main character, named Lyndon, bursts into a tattoo shop on Sixth Avenue heavily armed and wearing body armor.

“Within 2.3 seconds, he trained the muzzle on the girl - her head and throat - as she cowered on the bed and screamed. He shot her twice,” McLeod wrote.

And then: “If she had been quiet he might not have shot her so quickly; but women are noisy - like kids - and for that they must pay a price.”
On Monday, three of the five people McLeod allegedly killed were shot inside tattoo shops. According to Denver police, at one point during his hour-long rampage, McLeod entered a building on Sixth Avenue, chased the occupants and fired shots. No one was injured at that location.

McLeod named his publishing company Flat Black Ink. The books are available on Amazon, and there is an accompanying website with a blog and reviews.

At one point in “Sanction Book 2,” Lyndon meets Theodore Kaczynski, the infamous Unabomber, in prison.

“If there is no Unabomber there is no me,” Lyndon tells Kaczynski in the book. “We seek the same thing but from opposite ends of the extreme.”
McLeod will not get the chance to act out that disturbing scene. A Lakewood police officer shot and killed him near the Belmar shopping center, putting an end to a horrifying night of violence that was, literally and tragically, the stuff of fiction.

[snip][end]

So, I'm neither calling for censorship nor putting people under greater scrutiny ... BUT he wrote as Roman McClay, pen name, about a character named Lyndon, HIS REAL NAME, going on a killing spree at tattoo parlors.

This is exactly what he carried out in real life. He literally enacted a scene from one of his books.

I think what you're pointing to is the fact that there isn't a better mental heath system in our country. The description you gave describes someone who was beyond disturbed, was insane.

In any case it a better system if it existed couldn't respond before the fact to prevent things like this. Perhaps after the fact one could argue that this could have been foreseen and prevented. However before the fact attempting to proactively prevent that would create a system that would be overly intrusive and oppressive for all. Creating more harm than it did good.

Stupid analysis.

You guys invariably pull out the “mental health” card with these mass-murdering white cons. It’s like you deliberately misdiagnose the problem so that the problem is sure to persist.

Deadly white supremacism, violent white vigilantism, and misogyny are not “mental health” problems, they are part of white-conservative culture. Fix your sh#tty, broken culture; problem solved.

To be clear, although I myself did use that word to describe his actions, Mr. McLeod had no formal diagnosis of any kind from any professional, so there is no way to know.

Since you keep raising this point:

Here's a statement from mental health professionals:
https://www.mhanational.org/gun-deaths- ... tal-health

Mental Illness Is Not A Predictor Of Violence Towards Others, But It Is A Predictor Of Suicide. To Say Otherwise Is Misleading And Wrongfully Points A Finger At Tens Of Millions Of People Who Have Experienced Or Are Living With Mental Health Conditions
The vast majority of people with mental illness are not violent: 95-97 percent of homicidal gun violence is not carried out by individuals with a mental illness.

[snip]

Previous Violence Is The Only Evidence-Based Predictor Of Future Violence.

[snip]

When ranked with other countries of similar economic growth, the U.S. does not have a significantly higher proportion of people with mental health conditions than other industrialized countries, but does have exponentially higher rates of gun ownership and gun violence.

It is critical that the public and policymakers stop responding to gun violence and mass shootings with statements that mental health conditions are the underlying cause. The claim is false and discriminatory.

[snip][end]
In any case it a better system if it existed couldn't respond before the fact to prevent things like this. Perhaps after the fact one could argue that this could have been foreseen and prevented. However before the fact attempting to proactively prevent that would create a system that would be overly intrusive and oppressive for all. Creating more harm than it did good.
Dunno. How intrusive a society we want is always an important question.

For me, I certainly would want individuals scrutinized to some degree in a background check before obtaining lethal firearms. The degree to which this is the case can be discussed. I do not want everyone facing mental health issues to be blocked from obtaining one - I really don't see a necessity for someone to be flagged for suffering from depression 5 years ago.

Nor honestly for writing a novel in which the character, named after himself, goes on a lethal shooting spree; though I'd put that in a close call category. BTW, I don't know that makes him "mentally ill" - that is not the only cause of violent ideation.

By going into this same old tired "mental health" act every time yet another conservative white male shoots up a place, you add to the stigma of "mental health," and also give murderous misogyny and white supremacism a free pass.

It's like it's intentional.
