New California Laws for 2023

Beginning in 2023, Californians will have a number of new laws going into effect. Among these laws are:

1. Gender-affirming care: California becomes a sanctuary state for transgender health care and prevents legal action from states with bans and restrictions.

2. Abortion: Will protect medical records and cooperation with out-of-state entities abortion restrictions, expands abortion training options and providers, and protections for people from criminal or civil liabilities for pregnancy loss or abortion.

3. COVID-19: Requires workplaces to continue to provide employees notification with exposure notifications until 2024. Makes it easier for the California Medical Board to punish doctors who spread COVID-19 misinformation.

4. Labor: Raises minimum wage to $15.50. Requires employers to make salary ranges for available job positions to applicants and employees. Increase the share of paid family leave provide to lower-income Californians.

5. Public Safety and Criminal Justice:
a. Prevents police from using DNA collected from rape victims in the investigation of an unrelated crime.
b. Free prison phone calls for people detained in California prisons and jails.
c. Limits use of creative expression like rap lyrics in criminal cases.
d. Give law enforcement the ability to keep those in custody who are accused of organized retail theft.
e. Prohibits disclosure of a person's immigration status in open court in a criminal case unless approved by a judge.

6. Retail: Prohibits gender-based pricing on products based on who they're marketed toward. Bans the sale and manufacture of new fur clothing and accessories. Bans food packaging that contains PFAS.

This is known as a pink tax in that two products used by both men and women are charged different prices. For example, it costs more for a women to have her clothes dry cleaned than it does for a man.

If this list is accurate, they sound like just about the least controversial new laws I've seen in this state in a long time. Usually there's at least one real hooter. Not this year.

The hysteria over any of them would reflect badly on the person making the objection. In fact, it would be just about the dumbest thing I've ever read on this board, in all the years it's existed, and there are a lot of those.

These new laws seem reasonable. The only one I think that would need some limits on is free phone calls for prisoners. I think the purpose of this was to prevent telephone companies with prison contracts charging outrageous rates. Prisoners should be allowed a certain number of calls per month to family members and friends and no limits on the number of calls to their lawyers.

Protection of the DNA from people who may have committed a crime because they were a victim of a crime is wrong.
Does that law apply to all victims of crime or just rape victims. Either way it is a dumb law.

Just the victims. But without such a law rape victims don’t come forward. Which allows the rapist to keep raping. Such is right-wing logic.

If you use a rape victim's DNA against them in another case then you're discouraging them from reporting the crime of rape which only enables rapists to further exploit rape victims. This is like the law not disclosing the immigration status in court which allows undocumented immigrants to testify in court without fear of ICE or other law enforcement agencies arresting them.

Look, Glenn, if you’re arrested as a suspect of a crime, it’s reasonable to get DNA. But if you’re stopped for speeding, should you have to give your DNA? Or if you report a crime, should you have to give your DNA?

But, I will answer your stupid question.

If you are driving drunk and run a stop sign hit my car and the hospital for some reason had to take a sample of my DNA. If that DNA is found to make me a suspect in a crime then I should be arrested.

BTW from the dijaknow file. The government took my fingerprints back in 1981 when I obtained my liquor license.
The government dud a background check on me after 911 when I applied for a HazMat permit.
According to you if I go out now and commit a crime the government should not be allowed to use those prints or background information against me.
