Going back a bit. The "remain in Mexico" policy violated US and international law. The only reason it was in place was due to the pandemic, which could be invoked as emergency measures. Since the emergency no longer existed, the policy could not.
Whether you like it or not, any immigrant as the right to seek asylum. That opportunity is to be granted regardless of the possible outcome of the claim, and they have a right to have a hearing about it. They may well not have a legitimate asylum case, but it's for a judge to decide. Anyone on US soil is conveyed the rights available under the Constitution. This is the law. If the people want it to change, the law must be changed.
And no, they are under no obligation to seek asylum in the first country they arrive in. This is only an agreement between the USA and Canada.
They must be present in the country for which they are petitioning for asylum.
They are permitted to stay in the country until their disposition is adjudicated.
Things that could help
- Obviously, change the law.
- Fund the asylum system with more judges for quicker adjudications.
- Help fix their home countries. They would prefer to stay home
- Punish those who hire these immigrants. This will require some sacrifices from American citizens (eg: paying more for produce)
Do you have a link to that law? The President has wide latitude when it comes to immigration. Obviously we have a great number of migrants entering the country that don’t qualify and won’t qualify for asylum under our laws. They are gaming our system. They are being told what to say to CBP. Remain in Mexico kept those migrants in Mexico because it required them to apply for asylum in the first country they entered. The US in most cases was not the first country. This President via executive order threw out a policy that was working and replaced it with a policy that clearly isn’t working.
You can attempt to “put lipstick on the pig” of a policy that Biden has wrought but the numbers clearly reflect what a failure it is. Especially when compared to his predecessors. He can claim he needs additional authority. He does not. He broke it via executive order without congressional help. He can fix it via executive order. He has no problem with executive orders any other time.
IMO Biden did all this because it was working for Trump and we know all things Trump must be destroyed regardless. Cutting off one’s nose to spite the face. Secondly, it was done as a strategy to force an immigration policy on the right by turning this into a crisis. The right didn’t go along and it doesn’t look like they are going to go along. So all these migrants are nothing but political pawns on a political chessboard being controlled by Biden. I don’t think he gives a shit about them or about the stress this is putting on our social safety nets, health care and education, etc, etc etc.
It’s his policy. He claims he has done all he can. He should run on this policy. Folks who think it’s a success should vote for him so we can have more of these types of successful Biden policies.
