MID-YEAR UPDATE: 10 CONFLICTS TO WORRY ABOUT IN 2021: HAITI - ACLED
The political crisis in Haiti deepened during the first half of 2021, and the country now faces increased instability following the killing of President Jovenel Moise on 7 July. Both social unrest and gang violence intensified throughout the first six months of the year.

In early 2021, disagreements over the constitutional end of President Moise’s mandate prompted demonstrations led by the political opposition. These demonstrations occurred throughout January and February, accusing Moise of illegally exceeding his presidential term limit. Moise’s term ended on 7 February 2021, marking five years from the end of the previous term of former President Michel Martelly (BBC, 15 February 2021). Moise refused to stand down, however, claiming that his mandate extended to 2022 (Europa Press, 16 January 2021). In doing so, he cited a year-long delay to the final round of the presidential election, which prevented him from taking office until February 2017.

A proposed referendum by Moise to overhaul the existing constitution further sparked demonstrations. The proposal included a raft of changes, such as a transition from a bicameral to a unicameral legislature and reforms on the current limit of a single five-year presidential term to allow presidents to serve two consecutive terms (ConstitutionNet, 3 March 2021). The project has been rejected by the opposition, who note that the current constitution strictly prohibits holding referenda to modify it (Le Monde, 29 June 2021). Some critics also view the reform as an authoritarian move to reinforce presidential powers (AP, 3 February 2021).

Almost half of the anti-government demonstrations that took place during the first half of 2021 have been violent and/or destructive, with demonstrators regularly erecting flaming barricades and clashing with law enforcement. On some occasions, police have used live ammunition to disperse demonstrators, including peaceful protesters. Thus far in 2021, ACLED records five cases of excessive force against peaceful protesters — similar to rates seen during the entirety of 2020. Police have also targeted journalists covering demonstrations, with at least six such physical attacks reported so far this year.

Additionally, attacks targeting civilians have increased in 2021, in line with ACLED’s assessment at the beginning of the year. So far in 2021, ACLED records over 120 violence against civilians events, marking a 66% increase compared to the same time period last year. Civil society organizations have attributed responsibility for most of this violence to gangs, which allegedly work upon orders of ruling elites to fight for control of new voting constituencies (IHRC and OHCCH, April 2021). Gangs also work to silence opposition in neighborhoods of Port-au-Prince with strong anti-government sentiments, leading to violent incursions like that in the Bel-Air neighborhood, where at least 13 people were killed and others displaced during the spring between 31 March and 1 April (Miami Herald, 2 April 2021).

Is that an accurate criticism?

Well, the asylum function hasn't worked very well for a long number of years, the number of immigration judges, the backlog of now close to a million people awaiting asylum hearings.

The other thing that I think the general public doesn't understand is most people who apply for asylum never reach that threshold. They are denied asylum. And, therefore, they are returned to the country. But if they can't get the asylum hearing, that really tells you that the process is not working very well, if at all.

Yeah, that's basically what Obama said in that interview.

I didn't see any examples of abuse in that. Perhaps they think it is abuse that they've been expelling them. Or that there is a long wait for a hearing for those who don't get expelled.

I think it would be abuse if they were beating them up or not feeding them.

U.S. bars immigration arrests at schools, hospitals and other ‘protected areas’

U.S. immigration authorities will be restricted from carrying out arrests and other enforcement actions at hospitals, schools and a range of other “protected” areas under a new policy issued Wednesday by the Department of Homeland Security.

The policy goes into effect immediately and applies to both Immigration and Customs Enforcement and Customs and Border Protection agents, who will all receive updated training.

Audelia Molina, a Mexican immigrant, was earning 10 cents for every garment she trimmed at a factory in Los Angeles, America’s clothing-assembly capital. Her wage was so meager that she started putting in 11-hour days to drive up production. When she asked for a raise, a supervisor denied her request, so she quit in July 2017 — and turned to a labor-rights attorney to help her file an unpaid-wage complaint with the California Labor Commissioner.

A year later, the state found that Molina was paid, on average, $199 a week, violating overtime law and rules that piece-rate workers earn at least the state’s then $10.50 hourly minimum wage. But Molina’s employer didn’t pay her the almost $23,000 owed, not including attorney fees. Her best option was to apply to a state fund for cheated garment workers, a rare backstop California finances with business registration fees.

It took two more years before Molina received her check. Her former employer still hasn’t reimbursed the state fund, as required.

A 30-year resident of California, Molina got caught in a toxic cycle centuries old: Immigrants perform some of America’s lowest-paying, arduous jobs, and are among those most victimized by employers failing to pay them fairly. Even if they have support to file a lawsuit or a claim — with a state labor agency, as Molina did, or the U.S. Department of Labor — they often settle for less to get money faster or must wait as cases drag on.

“They pay whatever they want to pay,” said Molina, now 58, referring generally to the worst of garment factory employers she’s had over the years. “What interests them,” she said, “is that the work gets done, and fast.”

Lawmakers demand apology for border detention of Iranians




WASHINGTON (AP) — Two U.S. congresswomen renewed demands Tuesday for U.S. Customs and Border Protection to provide a formal apology and release records in connection with the January 2020 detainment of 200 Iranian Americans at the U.S.-Canada border.

Reps. Pramila Jayapal and Suzan DelBene, both of Washington state, sent a letter to the federal agency, requesting a public apology and renunciation of the hourslong detainment of travelers with links to Iran as they crossed the border from Canada into Washington in the days following a U.S. drone strike that killed a top Iranian general.

“Men, women and children legally entering or returning to the United States at a designated port of entry should not be arbitrarily held and questioned solely based on their religion, ethnicity, or national origin,” the lawmakers wrote.

Many of those detained in the days after the killing of Gen. Qassem Soleimani were U.S. citizens and some had even been cleared to participate in a program for trusted travelers.

“The Washington Post today published an extremely troubling report alleging the Biden administration blocked its own staff from enacting a plan to offer COVID 19 vaccinations to jailed migrants. According to the article, senior White House officials stepped in to halt the vaccination program because they feared it would attract more immigrants, refugees, and asylum-seekers to the United States.

“If accurate, this action is appalling and a moral outrage, and it demands swift action from President Biden. If true, it means the administration intentionally chose to expose migrants to a greater risk of sickness and death so it can better pursue a dangerous and immoral political strategy to deter people seeking entry into the United States.

“We demand the facts be made public immediately about the proposed vaccination plan and what happened to it — why it was blocked, and by whom. If the allegations in today’s article are proven true, then there are people in the Biden Administration who, at minimum, should resign and/or be fired. If anyone in the administration made a deliberate policy choice to withhold life-saving vaccines from incarcerated people at risk of infection — and if this was done to specifically send a message of deterrence — then there must be accountability. And President Biden must clearly and unequivocally repudiate the immorality of such a decision.

Unionists Defend Immigrant Protesters From Alt-Right Instigators in Times Square - Latino Rebels
Immigrant rights organizers say alt-right instigators arrived Tuesday night at their ongoing 11-day protest in Times Square looking to intimidate undocumented rally-goers.

“What they do is put their camera in your face and demand to know your name. Then they post it online and tell their followers to ID you so you can be reported to ICE,” said an undocumented organizer with National Immigrant Community Empowerment (NICE) who witnessed the confrontation.

Instead of undocumented immigrants to bully, however, the small group of alt-right instigators who showed up suddenly found themselves facing a wall of building and construction unionists from Local 79.
Videos on Twitter show unionists confronting the four or five instigators, one of whom is identified as Nick Fuentes, a 23-year-old alt-right media operative who took part in the Capitol insurrectionist on January 6 and was banned from several social media platforms including Facebook, Instagram, TikTok, Clubhouse, and most recently Twitter, along with business services PayPal, Venmo, Patreon, Airbnb, Shopify, and others.

Podcast: African Asylum Seekers’ Tell-All Tale of ICE Torture by The WRAP - The First Solution
Following two ICE-Air mass deportation flights to Cameroon tracked by Tom Cartwright of Witness at the Border in the fall of 2020, I couldn’t escape the rumblings of attorneys and advocates for the roughly 80 individuals the US government went to extraordinary lengths — and taxpayer expense — to return to a country wracked by protracted violence:

When “Ray” protested being returned to certain harm, he says the ICE Military “bagged and tied” him to force all others to comply, said one.
“Godswill” states that he was “stuffed into a sack” by ICE Special Forces and carried onto the plane like trash, recounted another.
“Castillo” claims he was bussed in a “bag” while also in five-point restraints from the detention center to the plane, and not “untied” until mid-way across the Atlantic, stated a third, horrified.

That was the first I’d ever heard of an Immigration and Customs Enforcement (ICE) “military.” And for the life of me, I could not figure out how any grown human gets stuffed into a sack!

I decided to track down and interview as many African asylum seekers as I could find with first-hand experience of the only air-charter operator willing to fly long-haul deportation missions for ICE: Omni Air International, aka “the Death Plane.” The results of this months-long investigation are now the subject of a complaint filed with the US Department of Homeland Security Office of Civil Rights and Civil Liberties (CRCL) and Office of the Inspector General (OIG) on October 13, 2021, by seven co-signing immigrants’ rights organizations.
Maybe Sam Lefthand the Ladder-Puller has a box of Kleenex for people subjected to WRAP. After all, his illegal, border-breaching relatives never were, and here he is.

So this is fine.

Each of them, two of whom spoke with TheGrio, have submitted signed declarations in support of the complaint filed by Black Alliance for Just Immigration, UndocuBlack, Haitian Bridge Alliance and the Texas A&M School of Law Immigrant Rights Clinic.

The abuses are alleged to have happened on or before two mass deportation flights that carried dozens to Cameroon, a war-torn country in central Africa, on Oct. 13, 2020, and Nov. 11, 2020. In each incident, ICE officials placed the migrants in The WRAP, which according to the complaint is supposed to restrain the legs “with the arms cuffed at the back, leaving the restrained in a seated, upright, 90-degree position so that the lungs and airways are free from compression.”

So, this is fine.
I saw a photo of someone in a WRAP device. It didn't look like it was torture to me. It looked like what one would want if they had to restrain someone who would not be orderly during a flight across an ocean.

Something understandable if the person who was being restrained was kicking and hitting and clawing anyone he could reach.
