Inmate Says He Was Raped, Retaliated Against at CoreCivic Prison in Arizona - Phoenix New Times

Lopez has since been fired. In August, she pleaded guilty to one charge of unlawful sexual conduct in a correctional facility — a Class 6 felony — and in October was sentenced to two years' probation, court records show. By law, she was not required to register as a sex offender.

Fuller maintains that he was raped.

"She forced herself on top of me," he told Phoenix New Times by phone. "I tried to tell her no, many times.”

Fuller also alleges CoreCivic attempted to stop him from sharing his version of events and from filing a lawsuit by retaliating against him in prison — throwing him into solitary confinement, and blocking him from calling lawyers and a sexual-assault reporting hotline.

Immigration attorney says 19-year-old Honduran mother was told she would be separated from newborn - San Diego Union-Tribune

CHULA VISTA — A 19-year-old mother from Honduras who gave birth Friday at Scripps-Mercy Hospital in Chula Vista while being detained by Border Patrol agents has been paroled following pressure from human rights advocates, her attorney said Monday.
She may get to remain in the San Diego area with her baby after pressure from lawyers and advocates, according to Hugo Ivan Salazar Gonzalez, one of her immigration attorneys.

The Honduran mother crossed the border Friday and turned herself over to Border Patrol agents, stating she was in labor and in need of medical assistance, which she could not get in Tijuana, her attorney said.

Agents took the pregnant woman to Scripps where she gave birth to an infant who had complications and needed to be placed in the Intensive Care Unit, Salazar said.

While she was visiting her baby in the ICU, she asked a Border Patrol agent when she could be released with her child and that’s when an agent told her she would be either going back to detention or returned to Mexico under the Migrant Protections Protocol program, her attorney said.

Under MPP, also known as Remain in Mexico, asylum-seekers are returned to Mexico to wait while their U.S. immigration cases are decided. Her attorney said she was seeking asylum but it was not clear under what circumstances the Honduran mother was making that claim.

Family members frantically called attorneys with Al Otro Lado, a pro-migrant legal services nonprofit, over the weekend claiming Border Patrol agents told the mother they planned to place her newborn child in the custody of Child Protective Services and then return her to Mexico without her baby.

Other sources from within the hospital were also communicating with the San Diego Union-Tribune that Border Patrol agents said they planned to separate the mother and the newborn baby.

A CBP spokesperson said “the mother and newborn were never separated by CBP.” This afternoon, the mother was provided a Notice to Appear in immigration court and released from CBP custody, the spokesperson said.

Since it ended, approximately 1,000 children have been taken from their parents anyway, according to government data presented in filings by the American Civil Liberties Union.

According to the government policy, Border Patrol agents can still separate parents from their children when a parent has a criminal history or if agents determine whether her or she is unfit to care for the child.

The ACLU argues the current policy still violates the rights of children and families.

Congress demands investigations into CBP’s use of fake court hearings to send asylum seekers back to Mexico - San Diego Union-Tribune

On Friday, Reps. Tony Cárdenas, D-Panorama City; Lou Correa, D-Santa Ana; and Veronica Escobar, D-Texas, led the coalition by sending a letter to the Department of Homeland Security’s Office of Inspector General asking for a “full and thorough” investigation.

“This type of behavior by a government agency is abhorrent, violates the rule of law, and is antithetical to our values and the very essence of what we stand for as a nation,” the letter states. It was also signed by Reps. Scott Peters and Juan Vargas, both San Diego Democrats.

Members of Congress specifically want to know whether any DHS or CBP leaders authorized the use of fake court hearings to send migrants back to Mexico and request that should any officials be found criminally liable they should be held accountable.

Friday’s letter is only the latest of what is mounting pressure from lawmakers on the Migrant Protection Protocols program, also known as Remain in Mexico.

Under the program, asylum seekers are forced to live in Mexico while their court cases are adjudicated in the United States. The Mexican government only agreed to accept returnees who have future court dates. However, CBP officials have given migrants whose asylum cases are already over documents with fake future court hearings and sent them back to Mexico anyway.

In November, Sen. Dianne Feinstein called for a hearing into CBP’s alleged practice of using fake court hearings to send asylum seekers back to Mexico.

Yes I remember my jaw dropping when they actually named it “Department of Homeland Security”. This agency can be broken back out into what the INS and border patrol was, not that la migra was ever a saintly organization. But yes under Bush and even Obama who ramped it up from Bush, ICE and CBP were never like this.

Dahlia Lithwick: Can you just start by explaining what it is that you do and how as a lawyer you were able to kind of amble in and out of border facilities, detention facilities?

Kristin Clarens: People who previously would have been detained [in the U.S.] are now living in sort of makeshift refugee camps on the Mexico side of the border because of the “Remain in Mexico” policy. So now it’s incredibly easy to amble in and out, as easy as it is for the cartel members and other organized criminals who are circulating in these camps.

The Remain in Mexico policy, the Migrant Protection Protocols, is just about a year old. Can you describe what the world was like before it, what the world has been like since?

The estimates are that there are around 3,000 people [in the tent camp in Matamoros] living just in squalor and in tents, and that 80 percent of them are families with young children. A year ago, in the Rio Grande Valley, most of those people would come to the United States either after asking for permission at a port of entry or after crossing without permission and they would be apprehended, put into one of the temporary facilities that so many of us have seen on the news with the kids in cages and the very overcrowded conditions, lack of sanitation and medical care. After that, the families and young kids were sent to longer-term detention centers where many of us, many lawyers who speak Spanish, have worked across the country.

As of June or July of this year, the United States government started implementing something that they call, I think very ironically, the Migrant Protection Protocols, which is a policy guideline that says that border patrol agents are able to return asylum-seekers to Mexico for the duration of their immigration hearings. So now an asylum-seeker who comes up from Central America arrives in these incredibly sketchy and stressful border towns, asks for asylum at the port of entry, and after a quick trip to one of the cage facilities, they are sent back into the streets of Mexico.

That moment where they’re shoved back into Mexican territory from the U.S. officials is an incredibly vulnerable one. It’s kind of like bad guys lurking on the sides.

Webb County Medical Examiner’s Office (WCMEO) has determined that the death is not suspicious, as the individual had a preexisting medical condition. So, this lady was medically cleared then died the next day. And this death is not suspicious?

DHS was, at best, a bad idea that found its time. What always interested me was how the precursor of the USA PATRIOT Act seemed to be bipartisan, and some Democrats who you'd think were above that kind of paranoid 1940s crap signed onto the original (pre-9/11) report proposing it.

Meanwhile, while we fret about our border wall or its absence, Russia just tested a new ICBM which is unstoppable with current technology. That's right, folks, the asshole drumpf pulled out of the treaty, and now he's started a new strategic arms race. Nuke anxiety is back.

But the MAGAs will go on with their white supremacist games.

Ever since 9/11 I’ve felt that living in SFCA was itself a nuclear deterrent. Nobody’s going to bomb this city and probably not this state, either, because so many righties would applaud it.

Harsh, inhumane separations of infants and children from their families within detention are ongoing despite the public reversal of President Trump’s “zero tolerance” policy in June 2018. Migrants newly crossing the border, including unaccompanied minors, are locked away from the family members they planned to reunite with in the U.S., even as they nurse the grief of being forced to leave behind loved ones in their countries of origin. U.S. community members are captured in Immigration and Customs Enforcement raids and other ICE actions and are torn away from their families, including their young children.

“The Most Horrible Thing I’ve Ever Done”: A Border Patrol Officer Who Separated Families Speaks Out - PBS

In the summer of 2017, nearly a year before the Trump administration’s family separations at the Southwest border sparked an international outcry, the Border Patrol was quietly piloting its own, local version of “zero tolerance” in El Paso, Texas.

In the FRONTLINE documentary Targeting El Paso, an officer tasked with separating migrant children from their parents under that pilot program speaks out — offering a rare public criticism of the initiative from within Border Patrol’s own ranks.

“That was the most horrible thing I’ve ever done,” Wesley Farris, a high-ranking officer with El Paso’s Border Patrol Union, tells FRONTLINE’s Martin Smith in the above excerpt. “You can’t help but see your own kids.”

Carrying out those separations, Farris says, was a tough order.

“I mean, none of us were happy about it,” Farris says. “But everybody around me was just doing exactly what… We were all told to do this.”

Experts say the tactic causes lasting trauma. In the above excerpt, Farris tells FRONTLINE about the effects he witnessed on a child during the last family separation he conducted.

“It was a young boy. I think he was about two. The world was upside down to that kid,” Farris says. “So when the contractor tried to take him away, he reached for me and he climbed up on me again, and he was holding on to me. So that that one got me a little bit.”

After that, Farris says he drew the line: “I said at that one, ‘I’m not doing this anymore. I won’t do it. I went back to the supervisor and I told him, ‘Don’t assign me to do that anymore.’”

Farris didn’t complain up the chain, but told FRONTLINE he wanted to.

As the documentary goes on to report, six months after the El Paso pilot ended, the Trump administration decided to scale up the program nationally to stem the flow of migrants — saying it had worked as a deterrent in El Paso.

“It aligned with my experience, in the times where we applied a consequence to people who cross the border illegally, we got less of them crossing the border illegally,” Ronald Vitiello, former acting director of U.S. Immigration and Customs Enforcement (ICE), tells FRONTLINE. “And so when zero tolerance is discussed as a way forward, we knew that it was going to be a benefit to us.”

“Zero tolerance” is just one of the immigration tactics piloted in El Paso. From producer Marcela Gaviria, correspondent Martin Smith and their team, the documentary Targeting El Paso investigates how the border city that’s been called the Ellis Island of the Southwest became a testing ground for some of President Donald Trump’s most controversial immigration policies, a subject of his anti-immigrant rhetoric, the site of a surge of migrant families crossing the border — and, on August 3 of last year, the target of a white supremacist with an assault rifle.


White supremacy, white nationalism, white conservatism and now the whole GOP is synonymous with "zero tolerance". (Always was).

Zero-tolerance is trash, zero-tolerance immigration polices are trash, the Trump administration is trash, DHS is trash, CBP is trash.
